One of the problems which surfaces in philosophical literature as regularly as clockwork is the status of tensed and tenseless discourse. This received its most influential formulation in McTaggart The Nature of Existence. Two philosophers who respond to McTaggart are Hans Reichenbach and J.J.C. Smart. In this paper, I review their analysis of token-reflexive terms. First, I examine Reichenbach’s arguments for translating tensed discourse into tenseless discourse. In order to show its subtlety, I also discuss Smart’s attempt to provide such (...) translations. This analysis is adequate for a limited number of tenseless utterances. Yet even Reichenbach’s analysis fails in certain important instances. That this attempt fails is a strong argument for supposing that any other such attempt will fail as well. Norman Geras argues for the incorporation of elements from the just war tradition into the ethics of social change. But this does not go far enough. In this paper I argue for a prefigurative constraint: that action intended to bring about social transformation ought to prefigure that transformation, and bear those properties of the future state of affairs that make the future state of affairs morally valuable. I defend the idea of a prefigurative constraint against some objections and introduce (...) a schema to relate political action to morally valuable end states. (shrink)

Teaching ethics is crucial to health sciences education. Doing it well requires a willingness to engage contentious social issues. Those issues introduce conflict and risk, but avoiding them ignores moral diversity and renders the work of ethics education irrelevant. Therefore, when (not if) contentious issues and moral differences arise, they must be acknowledged and can be addressed with humility, collegiality, and openness to support learning. Faculty must risk moments when not everyone will “feel safe,” so the candor implied in psychological (...) safety can emerge. The deliberative and social work of ethics education involves generous listening, wading into difference, and wondering together if our beliefs and arguments are as sound as we once thought. By forecasting the need for candid engagement with contentious issues and moral difference, establishing ground rules, and bolstering due process structures for faculty and students, a riskier and more relevant ethics pedagogy can emerge. Doing so will prepare everyone for the moral diversity they can expect in our common life and in practice. (shrink)

Scholars find that political elites are badly polarized over a large range of policy issues, but they tend to agree that the mass public is much more ambivalent. The abortion war in particular is regarded as one in which millions of ambivalent citizens are caught in the crossfire of polarized activists. Yet even abortion activists struggle to escape the very ambivalent sentiments that plague ordinary Americans. These common sentiments even exert a moderating influence on both movements in ways that are (...) consistent with the preferences of the American public. We argue that the stakeholder perspective on corporate social responsibility is in the process of being enlarged. Due to the process of institutional isomorphism, corporations are increasingly adopting organizational features designed to promote proactivity over mere reactivity in their stakeholder relationships. We identify two sources of pressure promoting the emergence of the proactive corporation -- stakeholder activism and the recognition of the social embeddedness of the economy. The final section describes four organizational design dimensions being installed by the more proactive (...) corporations today -- cooperation, participation, negotiation, and direct anticipation. Ageism has unfortunately become a salient phenomenon during the COVID-19 pandemic. In particular, triage decisions based on age have been hotly discussed. In this article, I first defend that, although there are ethical reasons (founded on the principles of benefit and fairness) to consider the age of patients in triage dilemmas, using age as a categorical exclusion is an unjustifiable ageist practice. Then, I argue that ageism during the pandemic has been fueled by media narratives and unfair assumptions which have (...) led to an ethically problematic group homogenization of the older population. Finally, I conclude that an intersectional perspective can shed light on further controversies on ageism and triage in the post-pandemic future. (shrink)

Talisse and Maloney seem to think that professors, not ordinary citizens, are the key to a more deliberative democracy. Yet these professors fail to appreciate the reasonableness of the pro‐life activists and thinkers they disagree with. For example, they falsely charge even the most deliberative groups with resurrecting an obsolete debate and framing conversations in a fallacious way. They further place an unreasonable justificatory burden on pro‐life activists and hold them culpable for framing the debate around the ontology of the (...) embryo . In drawing such a hard line between academics and activists, they also miss what has been an unavoidable partnership between academics and social movements in our imperfect deliberative republic. If we look at ourselves and find that we are unhappy or we are in circumstances which limit us, then Sartre states we have only ourselves to blame.

This Essay examines debates surrounding Qu Tongzu's ‘Confucianization of law’ theory. Qu's theory claims that Chinese law underwent a process of ‘Confucianization’ starting in the Han dynasty (202 BC–220 AD) and ending and culminating in the Tang dynasty (618–907), where the Confucian concept of li and other Confucian moral teachings were introduced and incorporated into the written law. I argue that Qu's theory should be properly characterised as a theory of descriptive jurisprudence and also a form of the mirror thesis. (...) In light of this characterisation, this Essay then lays out the possible counterarguments that could be raised against Qu's theory and then situates existing scholarship in the debate in these categories. I then test Qu's theory using a case study about kinship concealment in traditional Chinese law The Essay then concludes by urging that the debate should include more jurisprudential approaches. Professionalism requires that physicians uphold the best interests of patients while simultaneously insuring just use of health care resources. Current articulations of these obligations like the American Board of Internal Medicine Foundation's Physician Charter do not reconcile how these obligations fit together when they conflict. This is the problem of dual agency. The most common ways of dealing with dual agency: “bunkering”—physicians act as though societal cost issues are not their problem; “bailing”—physicians assume that they are merely agents of society (...) and deliver care typically based on a strongly consequentialist public health ethic; or “balancing”—a vaguely specified attempt to uphold both patient welfare and societal need for judicious resource use simultaneously—all fail. Here I propose how the problem of dual agency might begin to be addressed with rigor and consistency. Without dealing with the dual agency problem and getting more specific about how to reconcile its norms when they conflict, the expectations of professionalism risk being written off as cute, nonbinding aphorisms from the medical profession. The EBM+ programme is an attempt to improve the way in which present-day evidence-based medicine (EBM) assesses causal claims: according to EBM+, mechanistic studies should be scrutinised alongside association studies. This paper addresses two worries about EBM+: (i) that it is not feasible in practice, and (ii) that it is too malleable, i.e., its results depend on subjective choices that need to be made in order to implement the procedure. Several responses to these two worries are considered and evaluated. We evaluate here the performance of four models of cross-situational word learning: two global models, which extract and retain multiple referential alternatives from each word occurrence; and two local models, which extract just a single referent from each occurrence. One of these local models, dubbed Pursuit, uses an associative learning mechanism to estimate word-referent probability but pursues and tests the best referent-meaning at any given time. Pursuit is found to perform as well as global models under many conditions extracted from (...) naturalistic corpora of parent-child interactions, even though the model maintains far less information than global models. Moreover, Pursuit is found to best capture human experimental findings from several relevant cross-situational word-learning experiments, including those of Yu and Smith (), the paradigm example of a finding believed to support fully global cross-situational models. Implications and limitations of these results are discussed, most notably that the model characterizes only the earliest stages of word learning, when reliance on the co-occurring referent world is at its greatest. Value change is a phenomenon that is gaining increasing attention in ethical analyses of technologies. However, a comprehensive study of how reprogenetic technologies and values coevolve is lacking. To remedy this gap, in this overview article, I address the relationship between reprogenetics and value change. This contribution thus argues for the importance of investigating the phenomenon of value change in relation to the technological controversies discussed in bioethics. To meet this goal, I begin by clarifying, first, how technologies shape reproductive (...) choice. I then clarify what “values” and “moral values” are, how reprogenetic technologies are value laden, and what values are often discussed in reprogenetics debates. Next, I show five types of value changes that have occurred in advance in reproductive and genetic technologies. Finally, I argue for the bioethical relevance of discussing future techno-value change, pointing out the descriptive and normative challenges of this philosophical endeavor. (shrink)

Without taking a position on the overall justification of anti-doping regulations, I analyse the possible justification of Therapeutic Use Exemptions from such rules. TUEs are a creative way to prevent the unfair exclusion of athletes with a chronic condition, and they have the potential to be the least bad option. But they cannot be competitively neutral. Their justification must rest, instead, on the relevance of intentions to permissibility. I illustrate this by means of a set of thought experiments in which (...) only an athlete’s intentions vary. I argue that the Doctrine of Double Effect sheds some light on TUEs and illustrate this by applying different readings of the DDE to the thought experiment. This underpins a justification of anti-doping exemptions very different from the approach adopted by the World Anti-Doping Agency. I argue for three changes to bring TUEs in line with this understanding: rewriting of the regulations, transparency, and a greater role for athletes in determining what exemptions are allowed, and when. Panic buying of toilet rolls in Australia began in early March 2020. This was related to the realisation that the novel coronavirus was spreading across the country. To the general population the impact of the virus was unknown. Gradually the federal government started closing the country’s borders. The panic buying of toilet rolls was not unique to Australia. It happened across all societies that used toilet paper rather than water to clean after defecation and urination. However, research suggests that the (...) panic buying was most extreme in Australia. This article argues that the panic buying was closely linked to everyday notions of Western civilisation. Pedestal toilets and toilet paper are key aspects of civilisation and the fear of the loss of toilet paper is connected to anxiety about social breakdown, the loss of civilisation. This is the fear manifested in the perceived threat posed by the virus. (shrink)

On April 16, 2007, Cho Seung-Hui used two semiautomatic handguns to kill 32 persons and then himself at Virginia Tech University in the largest campus shooting in U.S. history. Mr. Cho purchased his handguns from a pawnshop and a gun store in Virginia, where under state law a background check was conducted to determine whether he had any disqualifying criminal or mental health history. The paperwork for the background check was completed at the gun store, and the check itself was (...) conducted through an “instant” system facilitated by a toll-free telephone number. The entire transaction took approximately 20 minutes. At no point was Mr. Cho asked why he wished to purchase the guns. And although he had been deemed a potential danger to himself by a state magistrate in 2005 – which should have disqualified his purchase of a gun under federal law – this information never reached those conducting the background check. In this paper I argue that the growing block theory of time has rather surprising, and hitherto unexplored, explanatory benefits when it comes to certain enduring philosophical puzzles concerning death. In particular, I claim the growing block theorist has readily available and convincing answers to the following questions: Why is it an evil to be dead but not an evil to be not yet born? How can death be an evil for the dead if they no longer exist to suffer (...) it? When is death an evil for the one who dies? The ability to give such answers is a significant, but by no means decisive, advantage for the growing block view of time. (shrink)

This book critically examines the debate on Martin Heidegger's concept of Entscheidung and his engagement and confrontation with Nazism in terms of his broader philosophical thought. It argues that one cannot explain Heidegger's actions without accounting for his idea of "decision" and its connection to his understanding of individual "fate" and national "destiny." The book looks at the relation of biography to philosophy and the ethical and political implications of appropriating Heidegger's thinking in these domains of inquiry. This paper provides a game-theoretic analysis of contrastive focus, extending insights from recent work on the role of noisy communication in prosodic accent placement to account for focus within sentences, sub-sentential phrases and words. The shared insight behind these models is that languages with prosodic focus marking assign prosodic prominence only within elements which constitute material critical for successful interpretation. We first take care to distinguish the information-structural notion of focus from an ontologically distinct notion of givenness marking, and then (...) outline the core properties of focus. We then introduce a signaling game between a speaker and hearer in which the goal is to transmit semantic content with the smallest signal possible. We apply the Iterated Best Response method of Franke to find equilibrium strategies in this game, where a unique equilibrium strategy in this case picks out the “critical information” of an utterance, which by hypothesis constitutes its focus. We show that iterating this game at different syntactic levels of a sentence makes correct predictions about the role of contrast in determining stress within words and phrases, and can be extended to account for association and second occurrence focus effects. How does one committed to the claims of Christ and a biblical story of redemption live Christianly and navigate the competing worldviews encountered in everyday medical practice? Adopting the practical conceptual framework promoted by Reformed Christian philosopher and theologian Albert Wolters, we argue for an all-encompassing biblical understanding of God’s cosmic redemption plan for the entire creation order in contrast to a more typical sacred/secular duality. We then apply the concepts of structure and direction, drawn from a pretheological understanding of (...) human life drawn from the Scripture, to a semi-fictional case study in discerning Christian faithfulness in everyday mundane aspects of medicine. Our subsequent analysis seeks to render an interpretation of what it means to live life consistent with that worldview when confronted with challenges like those presented in the case. (shrink)

A traditional ethic of medicine asserts that physicians have special obligations to individual patients with whom they have a clinical relationship. Contemporary trends in US healthcare financing like bundled payments seem to threaten traditional conceptions of special obligations of individual physicians to individual patients because their population-based focus sets a tone that seems to emphasise responsibilities for groups of patients by groups of physicians in an organisation. Prior to undertaking a cogent debate about the fate and normative weight of special (...) obligations and a traditional ethic for contemporary healthcare, we need a deeper examination of what the traditional ethic of special obligations really means. Here we offer a conception of ‘doubly distributed’ special obligations. Physicians and similarly minded healing professionals abiding by a traditional ethic have always spread their devotion and attention across multiple patients and have shared responsibilities with physician and non-physician colleagues in much the same way devoted parents have frequently distributed their special obligations across multiple children and across multiple parents. By taking up the extended analogy of parent we argue that doubly distributing special obligations need not contradict the possibility of special obligations in restructured collective forms of healthcare delivery and financing. Wikipedia has become increasingly prominent in online search results, serving as an initial path for the public to access “facts,” and lending plausibility to its autobiographical claim to be “the sum of all human knowledge.” However, this self-conception elides Wikipedia’s role as the world’s largest online site of encyclopedic knowledge production. A repository for established facts, Wikipedia is also a social space in which the facts themselves are decided. As a community, Wikipedia is guided by the five pillars—principles that inform (...) and undergird the prevailing epistemic and social norms and practices for Wikipedia participation and contributions. We contend these pillars lend structural support to and help entrench Wikipedia’s gender gap as well as its lack of diversity in both participation and content. In upholding these pillars, Wikipedians may unknowingly undermine otherwise reasonable calls for inclusivity, subsequently reproducing systemic biases. We propose an alternative set of pillars developed through the lens of feminist epistemology, drawing on Lorraine Code’s notion of epistemic responsibility and Helen Longino’s notion of procedural objectivity. Our aim is not only to reduce bias, but also to make Wikipedia a more robust, reliable, and transparent site for knowledge production. (shrink)

This paper investigates Hermann Weyl’s reception of philosophical concepts stemming from the German Idealist Johann Gottlieb Fichte. In particular, Weyl’s ‘agens theory’ of matter, which he held around 1925, will be looked at. In the extant literature, the—admittedly also important—influence of Husserl on Weyl has mainly been addressed. Thus, apart from investigating some detailed Fichtean inheritances in Weyl’s concepts of causality, chance and continuity, the general difference which Weyl saw between the philosophies of Fichte and Husserl will also be discussed. (...) For Weyl this is above all a difference between an active constructivism and a rather passive phenomenological seeing. Further, the paper shows in some detail the way Weyl was drawn into a certain reading of Fichte by his Zurich colleague, the philosopher Fritz Medicus. The methodological frame of the paper is that of Konstellationsforschung, a historical and systematic approach which proves to be particularly fruitful when investigating a German Idealist context and which allows special attention to be given to the acting subjects within the constellation under investigation. To be Black means to have ancestors whose humanity has been de-nied by slavery, colonialism, neo-colonialism, and segregation, as well as by many theories elaborated in order to justify and intensify these modes of domination. To be Black also means having to face the enduring legacies of these systems and theories, which predomi-nantly manifest through overexposure to violence and death. Today, premature death and habituation to loss remain constitutive fea-tures of Black experience. Dignity, often de????ined as the inherent value of (...) every single human being, has been a core concept in ethics since Kant, at least. But in both philosophy and modern politics, the claim of respect for the dignity of people has coexisted with deep antiblack-ness. However, apart from the Western understanding of dignity stands another tradition. The concept of dignity is pervasive in Black radicalism, Caribbean philosophy, and African thought since the 18th century. This article draws inspiration from the legacy of these thinkers to elaborate an ethics centred on the speci????icities of racial-ized life. (shrink)
